CommonGoal AI Terms of Service

Introduction

CommonGoal AI, a product of The Call List, LLC, a Missouri limited liability company (“CommonGoal AI,” “The Call List”, “we,” “us,” or “our”), offers a platform for thought leaders and experts to create and share AI-driven Prompt Packs. These Terms govern your access to and use of CommonGoal AI's services, including our website, mobile applications, videos, channels, data, text, images, or other materials (collectively referred to as the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

Basic Terms

Platform: CommonGoal AI serves as a service provider and processor of information in its provision of the Services.

Responsibility: You are responsible for your use of the Services, any content you post, and the consequences thereof.

Registration and Access

Minimum Age: You must be at least 13 years old or the minimum age required in your country to use the Services. If under 18, you must have your parent or legal guardian’s permission.

Registration: Provide accurate and complete information when registering for an account. Do not share your account credentials and be responsible for all activities under your account.

By registering for an account, you represent that you will not use the Services to post or distribute medical guidance, advice or recommendations or use the Services in any manner that poses a risk of harm.

If you register using an email owned by an organization, your account may be transferred to that organization's administration and use subject to its internal policies.

Privacy

Your information is collected and used as set forth in the CommonGoal AI Privacy Notice.

Using the Services

You may only use the Services for lawful purposes and in compliance with these Terms and all applicable laws. Prohibited uses include using our Services in any manner that could harm us, our Services, or others. For example, you may not:

Copy, modify, host, stream, sublicense, or resell any part of our Services. Use our Services for any competitive purposes. Impersonate others or intentionally falsify your affiliation with a person, entity, or service. Use our Services to distribute spam, phishing schemes, or other unsolicited communications. Circumvent any access restrictions or usage limits. Use our Services to host or distribute harmful code. Interfere with the proper operation of our Services. Violate applicable laws, regulations, or Terms of Service in connection with your use of the Services.

Any software we provide you as part of the Services, including mobile applications, is licensed to you under these Terms. Third party software included in our Services may be governed by separate license terms we make available to you.

The Services may allow access to third party services and content. We are not responsible for this third party content.

We welcome your feedback on the Services. You grant us the right to use any feedback without restriction.

Content on CommonGoal AI

Responsibility: All content, whether publicly broadcast or privately transmitted, is the sole responsibility of the person who originated it.

No Liability: We are not liable for content generated by users or AI. Content should not be interpreted as professional advice of any kind, especially medical guidance or advice. You may not rely on any Content from the Services as a substitute for professional advice.

Your Rights in Content

License: By broadcasting, submitting, posting, or displaying content, you grant CommonGoal AI a worldwide, non-exclusive license to use such content.

Ownership: You retain whatever rights you may have to any content you broadcast, submit, post, or display on the Services.

Your License to Use the Services

Grant: Subject to ongoing compliance with these Terms, we grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided as part of the Services.

The Call List’s Rights

Ownership: All rights, title, and interest in the Services, excluding user-generated content, remain with CommonGoal AI and The Call List, LLC.

Paid Accounts

Billing. If you purchase any of our fee-based Services, you agree to pay all applicable fees. All fees will be disclosed to you in advance. We may change our fees from time to time by posting the updates on our website or providing notice to you.

Payment. You will provide complete and accurate billing information including a valid payment method. We automatically charge your payment method periodically based on your subscription plan. By providing payment information, you authorize us to charge you for the Services.

Taxes. You are responsible for any applicable taxes. We will charge tax when required to do so.

Non-Payment. If we cannot successfully charge your payment method, we reserve the right to suspend or terminate your access to the paid Services. Late payments may incur additional fees.

Cancellation. You may cancel your paid Services at any time. Contact our Support team to request cancellation. Cancellations take effect at the end of your current subscription period. Payments are non-refundable except where required by law.

Changes. We may change, discontinue, or deprecate any of our Services by providing you notice. If we discontinue a paid Service, you will receive a prorated refund.

Community Guidelines

Content Restrictions: Do not post content that is offensive, harmful, or violates others' rights. You may not use the Services to publish or distribute medical guidance, advice, diagnostic opinions or treatment recommendations. You may not use the Services in a manner that poses a risk of physical harm, encourages dangerous or illegal activities, or provides instructions for such activities.

User Conduct: Do not engage in activities that disrupt or misuse the Services.

Termination and Suspension

Termination: You or CommonGoal AI may terminate these Terms as outlined.

We may discontinue any or all of the Services by providing you advance notice. If we discontinue a paid Service, you will receive a pro rata refund.

Disclaimers and Limitations of Liability

Disclaimer: The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.

Limitation of Liability: Our liability is limited as described in these Terms.

If you are a business user, you agree to indemnify us from third party claims relating to your use of the Services or any Content you provide.

Dispute Resolution

Arbitration: Disputes arising from these Terms will be resolved through binding arbitration in St. Louis County, Missouri, unless otherwise agreed.

Identification of the copyrighted work claimed to be infringed
Identification of the infringing content
A statement that you have a good faith belief the use is not authorized

Governing Law

Jurisdiction: These Terms are governed by the laws of the State of Missouri.

General Terms

Amendments: CommonGoal AI may revise these Terms from time to time, with notice provided for material changes.
